The Texas Insurance Code regulates the insurance industry and mandates specific regulations regarding unfair insurance practices. Under Texas law, if your insurance company has caused harm to you by engaging in unfair or deceptive practices, you can file a lawsuit against the insurer for damages. Specifically, it is illegal for an insurance company to engage in any of the following:
· Misrepresentations and false advertising of policy contracts
· Misrepresentation of insurance policies
· Unfair settlement practices
· False information and advertising generally
· Unfair discrimination
· Rebates; and
· Deceptive names, words, symbols, devices, and slogans.
The Texas Insurance Code also mandates certain time periods for an insurance company to acknowledge, investigate, and accept or reject a claim. In most cases, an insurance company must respond to your claim within 15 days. However, they are entitled to request more time to investigate and determine whether your claim will be accepted for denied. The company must, at least, inform you of that within the 15-day period.
